What is a Certificate Provider (CP)?
When an individual applies to make a Lasting Power of Attorney, a Certificate Provider (CP) plays a crucial role in certifying that the person knows what they are doing. This is not a formal assessment of capacity, and non-professionals can act as certificate providers, such as a neighbour or friend who is not an attorney. Still, this person must have known you for several years, and they may not have the right training, skills or ability to formally attest and confirm you have the required legal mental capacity.
Do you offer a professional Certificate Provider service and how much do you charge?
Yes we do, we can act as a stand-alone certificate provider or undertake the role of professional witness and/or certificate provider at no additional charge as part of our capacity assessment service. Our fees for acting as a stand-alone professional witness or certificate provider for a Lasting Power of Attorney starts from £150 (no VAT applies), and no charge is made if you ask us to undertake your mental capacity assessment and we complete this on the same visit.
How do I ask you to act for us as a Certificate Provider or support my Lasting Power of Attorney?
Instruct us (which means you ask us formally to act for you). We have a few forms we will email you, including a consent form, a scoping form and our privayc policy which explained how we look after your data. We ask you to sign our terms of engagement, which is a short contract to make our assessment legal and binding and we book your assessment with one of our experts. The assessment includes a face to face meeting with the client and family (if you like), and we formally assess your capacity to make an LPA. One client told us recently although it was an assessment, it "...felt like a nice chat." So we are really skilled at making the whole process relaxing and ensuring you feel comfortable and trust us. Can you support us in making a LPA?
In some cases, yes. We can offer some practicable support which is called our LPA check and support service, which is not a legal service, so our fees are a fraction of the cost of using a solicitor. Our fees for supporting an LPA start at £175 for one LPA completed online and we post the pack to you with clear instructions on what to do next, or we can do the whole process for £295. This fee excludes the OPG registration fee, which is payable to the Office of the Public Guardian (OPG). Unless you purchase the Gold Package, we can add this service to our invoice and you get a compete service from start to finish. We also track and keep you updated at every stage, and we just ask for an additional admin and postage fee, nothing else...and no VAT is added!
