What is a COP3, and do I need one?
The form COP3 is a capacity assessment when applying to the Court of Protection, and it's the third form on the application bundle, hence COP3. If you ask the Court of Protection to decide about someone's health, welfare, property or affairs, and that person lacks the mental capacity to make the decision themselves, then you will need a completed COP3. The judge will not consider the case without a valid COP3 completed, and often we are asked by lawyers to provide this to assist the court in making a decision.
Are you qualified to complete a COP3?
Yes, we are, and to date, we have had 100% of our COP3s accepted by either a judge or an authorised court officer acting under special delegated powers. We are a leading expert in this practice field and have been since 2016.
What COP3 service do you offer?
We offer a detailed and comprehensive capacity assessment service covering both England. Some of our staff can practice in Wales. We are based in the South, but some associates often travel or visit the North frequently.
How long does your COP3 service take?
We aim to have all completed COP3s or capacity assessments returned no later than 10 days from the assessment date. We meet around 98% of our work within this timescale.
I need it quicker than a week, can you do this sooner?
Yes, we offer a 'rush service' for a small fee and can work with you to complete the work within 5 days. We also work out of hours or weekends for urgent work for an additional fee.
What are your fee ranges?
What do you operate a ranges of fees for the same work, can you not fixed a price?
We follow the guidance issued by BASW for Independent Social Workers, and we price ethically. This means if your assessment takes us less time, you pay us a lower fee; we think that's how professional services should work. We carefully assess your individual case and looks at two main factors - the complexity of the case and how urgent you need the assessment. Each new client or potential client will have an individual quote, drafted by a senior member of our care and health team. If you would like a fixed fee, we are most happy to do that for you, as some people like to know a final price. However, since implementing our new fee method since April 2024, we have never charged a client more than quoted. Nevertheless, we want you to trust us, so if you feel comfortable having a fixed price, please do let us know.

- Our standard work covers all non-complex casework that is not contentious or reassessing an existing capacity assessment. Our fees for this work starts from £425-£525 and cover all case preparation, reasonable reading time and report writing.
- Our specialist work covers some contentious or challenging cases where a more extended assessment or reading of the case may be required. Fees for this type of work starts from £545-795 and cover all case preparation, reasonable reading time and report.
- We offer retrospective capacity assessments starting at £1,300 and this covers a full report and reading up to 250 pages.
